They buried the actual relevant legal detail at the bottom of the article. There is some basis for the lawsuit because she’s saying she was over-served and it is illegal to over-serve people in Canada. Over-serving has caused people to be seriously injured or killed in the past and businesses have been held responsible depending on the circumstances. There is actually a duty of care not to let people drink too much and to, within reason, ensure that they get home safely. Whether or not she actually was over-served and/or the venue acted improperly when they kicked her out…stay tuned for the court case, I guess. Who knows if she’s telling the truth or just hoping to push the liability onto the company which has bigger pockets. Even if she is being honest, depending on the circumstances the company may or may not be liable. These things are always very fact based as the article mentions.

No, I'm saying this because the contrary seems to be unbelievable. I serve alcohol for a living, and one of the things they drill into our head, is if you over serve someone, you are responsible for everything they do after they leave your venue.
